These Terms of Service (“Terms”) govern your access to and use of the ExpressOnHold website and services (the “Services”), operated by ExpressOnHold, a service of BusinessVoice. By placing an order or using the Services, you agree to these Terms. If you do not agree, please do not use the Services.
The service
ExpressOnHold produces custom on-hold messaging audio. Depending on the option you select, you may provide your own script or have a script drafted for you based on the information you submit in your production brief. Productions include written script, professional voice talent, and background music, mixed and delivered as a digital audio file.
Orders and payment
Prices are shown at checkout and are charged at the time you place your order. Payment is processed securely through our payment provider, Stripe. By submitting an order, you authorize us to charge the applicable amount to your selected payment method.
Scripts and revisions
For orders where we draft your script, you may request up to three (3) script revisions before approval. Once you approve a script, it moves into production and the voiced production is created from the approved text. Voiceover audio itself is not subject to customer revision after approval. Additional changes after approval may require a new order or additional fees.
Your content and responsibilities
You are responsible for the accuracy and legality of the content you provide, including scripts, business information, and any materials you upload. You represent that you have the rights to all content you submit and that it does not infringe the rights of others or violate any law. You agree not to submit unlawful, infringing, or offensive content.
Licensing and ownership
Upon full payment, you receive a license to use the completed production for your business's on-hold messaging. Background music and voice talent are provided under licenses arranged by ExpressOnHold and are licensed to you for use within your delivered production only; they may not be extracted, resold, or used independently of the production. We retain ownership of our underlying templates, tools, and processes.
Delivery
We aim to deliver completed productions promptly, typically within a few business days after we have everything we need from you. Delivery timelines are estimates and not guarantees, and may be affected by the completeness of your brief, the revision process, and other factors.
Refunds
Because productions are custom-made for you, orders are generally non-refundable once production has begun. If you have a concern about your order, contact us and we will work with you in good faith to make it right.
Disclaimers
The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components.
Limitation of liability
To the fullest extent permitted by law, ExpressOnHold and BusinessVoice will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues. Our total liability for any claim arising out of or relating to the Services will not exceed the amount you paid for the order giving rise to the claim.
Governing law
These Terms are governed by the laws of the State of Ohio, without regard to its conflict-of-laws principles. Any disputes will be subject to the exclusive jurisdiction of the state and federal courts located in Ohio.
Changes to these terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
